Instead of waiting, he's just using executive powers to gut it from the inside out. He is shifting special education oversight to the Department of Health and Human Services, and moving civil rights enforcement over to the Justice Department.
It is like trying to shut down a restaurant by sending the kitchen staff to a catering company and the waiters to a security firm. The building is technically still there, but good luck ordering a sandwich.
Bureaucracy is undefeated, but this is one hell of a workaround.
