SCOTUS rules states can ban transgender girls from school sports
Well, the highest court in the land just dropped its final pre-summer-break rulings, and they’ve officially given states the green light to keep biological boys out of girls' locker rooms.
The Supreme Court decided to tackle one of the most exhausting culture-war topics of our time. In a classic split decision, they ruled that public schools can define eligibility for girls' sports based purely on biological sex.
Writing for the majority, Brett Kavanaugh essentially said that we do not need to rewrite the entire playbook of American athletics. If a state wants to keep girls' sports strictly for biological females, the Constitution and Title IX aren't going to stop them.
Naturally, the liberal justices were not thrilled. Sonia Sotomayor argued that the court is basically moving the goalposts without even looking at all the scientific facts first.
Meanwhile, the lawyers for the trans athletes who sued are devastated, calling it a heartbreak. But the ruling leaves a fascinating loophole: states "may" discriminate, not that they "must". So basically, the map of high school sports is about to look as divided as a presidential election map.
High school track meets are about to become the new legal battlegrounds, which is exactly what every teenager wants to deal with during puberty.
