DOJ Moves to Erase Steve Bannon's Conviction

Original version ·

Nothing says modern justice quite like doing four months in federal prison only to have prosecutors show up later saying never mind.

Steve Bannon already served his four-month stint behind bars for telling Congress to get lost during the January 6 inquiry. The cell doors locked, the days ticked down, and the sentence was fully completed.

Now, federal prosecutors are marching back into court asking a judge to vacate the conviction entirely, arguing that punishing him clashes with the current administration's enforcement priorities. The new argument is that he genuinely believed executive privilege shielded him from testifying, so prosecuting him was inappropriate all along.

A federal judge appointed by Donald Trump already rejected this exact dismissal attempt once in August for lack of legal justification, but prosecutors are giving it another spin.

Time served used to mean the end of the legal road, but apparently even a finished prison bid can be submitted for retroactive store credit.
