Comey Fights to Toss a 10-Year-Old Espionage Charge
The DOJ is dragging James Comey into court over a 2016 leak, but they somehow forgot the actual grand jury indictment.
The feds are digging deep into the archives to nail James Comey under the Espionage Act for talking to The New York Times back before the 2016 election. Two separate prosecutors' offices already investigated this exact leak years ago and took a pass, but apparently the third time is the charm.
Here is where it gets bizarre: the government filed charges without actually getting an indictment from a grand jury before the ten-year statute of limitations ran out. When Comey's lawyers asked the judge to throw the whole thing in the trash, prosecutors countered that he cannot legally ask to dismiss the case because they never formally indicted him yet. That is top-shelf bureaucratic jujitsu.
This is the same agency that recently went after him for arranging seashells on a beach to spell "86 47" and tried to argue it was an assassination threat against Donald Trump.
Turning decade-old press leaks and beachfront seashell photos into federal espionage drama is quite the strategy for filling up a court docket.
